Terms of service

1. Agreement

These terms govern your use of the GenCart AI website at gencart.ai and any related services we operate ("the Service"). By using the Service, you agree to these terms. If you don't agree, please don't use the Service.

For separately-negotiated terms (enterprise agreements, DPAs), the negotiated document supersedes these terms where there's a conflict.

2. What we offer (today)

GenCart AI is in private beta. This website is currently a waitlist landing page; the product itself is available by invitation. References on this site to product capabilities describe what GenCart does for invited merchants — they are not an offer to the general public.

3. Account access

Joining the waitlist does not create an account or guarantee access. We approve invitations at our discretion and may decline without explanation. If you're approved, separate merchant terms will apply to the product itself.

4. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract underlying models or prompts.
• Use the Service to harass, deceive, or harm anyone.
• Use the Service to handle data you don't have the right to handle.
• Probe, attack, or attempt to bypass the Service's security or rate limits.
• Resell or sublicense the Service without our written permission.

5. Beta nature of the Service

The Service is provided on an "as-is" and "as-available" basis. Features may change, break, or be removed without notice while we iterate. Uptime is not guaranteed; do not rely on the Service for mission-critical operations during the beta.

6. Your content

You retain all rights to the content you submit (waitlist details, messages, catalog data when applicable). You grant us a limited, non-exclusive license to process that content for the sole purpose of operating and improving the Service. We do not use your content to train third-party models, and we do not sell it.

7. Our content

The Service, its design, code, copy, and brand are owned by GenCart AI or its licensors and protected by intellectual-property law. We grant you a limited, non-transferable license to use the Service as intended. We reserve all rights not expressly granted.

8. AI-generated output

Responses from the GenCart assistant are generated by large language models and may contain inaccuracies. Treat them as suggestions, not authoritative advice. We're not responsible for purchasing, medical, legal, or financial decisions made on the basis of AI-generated output.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied — including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, GenCart AI, its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the Service. Our total aggregate liability for any direct damages is capped at €100 or the amount you've paid us in the prior 12 months, whichever is greater.

11. Indemnification

You agree to defend and indemnify GenCart AI against claims arising out of your misuse of the Service or breach of these terms.

12. Termination

We may suspend or terminate your access at any time if you violate these terms or if we discontinue the Service. You may stop using the Service at any time.

13. Governing law and disputes

These terms are governed by the laws of Greece and the European Union, without regard to conflict-of-laws principles. Disputes are subject to the exclusive jurisdiction of the courts of Athens, Greece, unless mandatory consumer-protection law in your country provides otherwise.

14. Changes

We may update these terms as the product evolves. Material changes will be communicated on this page with a refreshed "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
